The right to request flexible working from your employer is a day one right, which means you can make the request at any time from starting employment.
A flexible working request can be made for various reasons and is not limited to requests relating to parental or caring responsibilities.
A flexible working request may be made to change the hours you work, the times you are required to work and/or your place of work.
To make a flexible working request, you must be classed as an employee. Up to two requests for flexible working can be made in any 12-month period, but you cannot make a second request if the first request is still in the process of being reviewed.
Agency workers and employee shareholders returning from a period of parental leave can also make a flexible working request, but there may be short time frames within which this must be done.
If you are unsure of your worker status (e.g. whether you are an employee or not), you may want to enquire with your employer or seek legal advice.
While your employer isn’t obligated to approve your flexible working request, they must deal with it in a reasonable manner and consult with you before refusing the request. They must notify you of the decision within two months, though this two-month period can be extended if you both agree. If your employer fails to take these steps, you may be able to make a claim.
